I dont' know how it is in all localities, but here it is a __ step process.

The county or state treasurer must declare the property taxes are in arrears. Then the property is listed in the sheriff's auction and anyone willing to pay the full back taxes then becomes the legal title holder. That has happened a number of times here to $150,000 homes with families still living in them who owed a couple years back taxes... The entire property was purchased for less than $8k.

Good luck on the property -

The actual procedure will very from state to state. California, the auction does not need to be conduct by a Sheriff and the property can be auctioned off after 5 years of delinquent property taxes. The best thing to do is contact tax collector or county assessor to about local procedures.

Local lawsYes, it depends upon local laws and regulations. The tax collector may have to meet certain standards of diligence in attempting to locate and notify the current owners, and attempting to collect, prior to filing a tax deed to the municipality. After that, the local laws may permit public sale (auction) of no more than a quitclaim deed, or may provide a "bargain and sale deed" if the payment covers the delinquent taxes.

Please be aware the most property acquired by tax auction is deeded to the new owner with a quitclaim deed which does not provide the same level of ownership and protection as a normal warranty deed.

If an estate has been closed 42 years and it was discovered that property in the estate exists can that property be transferred to another entity?

If the estate was probated 42 years ago the title to the property would have passed to the heirs. An attorney will need to review the file and determine if the property passed under the will or as intestate property. The estates of any heirs who inherited an interest and died during the interim would need to be probated. An attorney should be able to determine what needs to be done so that you can convey good title. You should consult with an attorney who specializes in probate and real estate in your area.

When an acre of land has been lived on solely by one heir for ten years all other heirs but two have signed land over to resident heir what are the rights of the two heirs who haven't signed?

The two remaining heirs still hold legal rights to the land, even if they have not lived on it. They cannot be forced to sign over their rights without their consent. They may have the option to claim their share of the inheritance or negotiate with the resident heir for compensation. Legal advice should be sought to explore options for resolution.

Why would the government essentially allow a thief to acquire the title to someone elses property?

The government would not allow a thief to acquire title to someone else's property. There are laws that allow land that has been idle and unmaintained for a number of years to be acquired by adverse possession. Also, in a land dispute the court will rule in favor of the litigant with the best evidence of ownership.

How do you change property title for parent deceased 10 years with no will?

You need to consult with an attorney and arrange to have your parent’s estate probated. An estate that contains real estate must be probated in order for the heirs to acquire legal title. As long as your parent’s estate remains unprobated you are not the legal owner of the property. The situation creates a cloud on the title.

How long does a lien remain on property you don't own yet but will inherit but there is no will so the land is not in your name but it will be tied with other inheriters?

It depends on the lien. Most liens have a statute of limitations whereby they eventually become extinguished by time. In Massachusetts a mortgage lasts 35 years. A property tax lien lasts forever until it is paid or the town takes the property. You need to check specifically for the type of lien and the state. As for your inheriting the property: Once the owner dies their estate must be probated in order for title to pass to heirs legally. It depends on the lien.
