Can you pay someones taxes and own their land?

No. Generally you cannot get title to property simply by paying the delinquent taxes. The procedures vary from state to state but there needs to be a transfer of title. Towns have the legal authority to take possession of real property for non-payment of property taxes. In some jurisdictions the town must then get a court decree that perfects title in the town. Once the tax taking process is completed the town can sell the property at a public auction and the delinquent taxes must be paid. You need to check the procedure in your particular jurisdiction. Tax sales are usually advertised in the local newspaper.

Generally, when you pay taxes assessed to someone else for property they own, you are simply considered a volunteer.

If you are thinking of trying to acquire a property by adverse possession one of the common elements is paying the taxes on the land. Laws vary. In Texas can they repo a car from your driveway on personal property?

The law can come and remove anything from anywhere if it is on a no parking place, tresspassing, or if you haven't been paying your bills. If you signed the contract to the car saying the car could be repossessed, the government practically owns your car. If you didn't read a contract that you signed that makes it your fault.

The only time I've ever had the law on my side while in the process of a repossession is when it's been court ordered. For instance a bankruptcy judge orders a debtor to surrender a piece of collateral, and the order has been ignored ! Other than that a repossession is a civil matter and the local police will not get involved. More to the point, the answer to the original question is yes ! The collateral can be take from private property or a drive way and that's pretty much in any state.

You did agree to surrender the collateral if you can no longer pay for it. It is stipulated on the contract you signed on that oh so happy day you bought that car. It's just in very fine print on the back and that very helpful sales person, didn't quite explain what all the fine print said in plain english.


You should always check with local law enforcement. In Parker County, a Repo agent must appear before the County Judge with the paper work to repo. The jugde has to approve the repo before hand.

I dont' know how it is in all localities, but here it is a __ step process.

The county or state treasurer must declare the property taxes are in arrears. Then the property is listed in the sheriff's auction and anyone willing to pay the full back taxes then becomes the legal title holder. That has happened a number of times here to $150,000 homes with families still living in them who owed a couple years back taxes... The entire property was purchased for less than $8k.

The actual procedure will very from state to state. California, the auction does not need to be conduct by a Sheriff and the property can be auctioned off after 5 years of delinquent property taxes. The best thing to do is contact tax collector or county assessor to about local procedures.

You need to contact the owners of those properties and make an offer to buy.

If they are tax title properties then you need to contact the assessor and ask when the sale of those properties will be conducted. You need to know what you will be required as a down payment. Also, you should have an idea of how much is due in delinquent taxes and any other municipal charges.

It's not a "can"...it's a must! ALL of your assets, of all types, MUST be disclosed and reported in BK, and ALL of your liabilites/debts must be too. No exceptions, no picking and choosing. Not disclosing all items is frequnetly easily discovered, in which case - as you are swearing under oath to the court you included all info - your case is dismissed, and regularly, fraud charges are pursued.
