The law was much different at the end of the 19th century than today. Or at least the punishment part of the law. An example of this difference would be the U.S. west where it was punishable by death to steal somebody's horse. In a lot of cases the gun was the prevailing way to handle a criminal. Or the end of a rope. Modern forensics were an unknown, almost 100 years in the future. Most times a person's life depended on eye witness's. Unfortunatly, studies have shown that eye witness testimony is one of the most flawed when trying to establish proof and truth. Not really on purpose, but people, even the most honest, are subject to 'getting it wrong'. We forget, or influenced by outside factors.
In San Diego, California in the late 1800's a man known as 'Yankee Jim' was hung for stealing a row boat. Nobody was more suprised than Jim himself. He was prepared for a short stint in the local lockup, which he got, being held in the jail until his execution.
