Technically, they are fresh because they aren't canned. However most tomatoes that make it to supermarkets are picked while still green and ripened artificially. Does that make them fresh? Unless they have soft spots they aren't spoiled but truly fresh tomatoes may only be available if you grow your own or know of a good produce market that's supplied locally.
