Actually, kids can only have a lemonade stand without a license if it's on private property. If its at your house, no problem. If you try to have it at a park or a sports game etc... you may run into trouble. I would hope that most cities are lenient, but there are many cases of children being fined for not having a permit... usually around $500.
You must obtain a business license and get permission from the county. You must also have a health inspection prior to serving any food or drinks. So you could. Just would would be too much to sell 25¢ cups of lemonade.
