Actually, kids can only have a lemonade stand without a license if it's on private property. If its at your house, no problem. If you try to have it at a park or a sports game etc... you may run into trouble. I would hope that most cities are lenient, but there are many cases of children being fined for not having a permit... usually around $500.

Try an old fashioned lemonade stand. The kids enjoy being part of the whole process. Building the stand, making signs, serving the lemonade, then counting up the proceeds gives them lots of actual involvement.

Like a yard sale, a lemonade stand requires a permit, technically. Will the police hassle a couple of kids in a lemonade stand? Probably not...unless the stand causes a disturbance or an obstruction or receives a complaint. Do not set it up on the sidewalk, do not set it up beyond the sidewalk, set it up in the yard with enough room for someone to step off the sidewalk and make a purchase, play any music at a low level, and get permission from the landowner. Noise and blocking the sidewalk are the major complaints to avoid. If you want to make your lemonade stand a real business, check with the city or county that you are going to operate the stand in.
