how could it be anyone else's fault? Yes it is obviously their fault and their liability insurance should pay for it. If they don't want to submit the "claim" to their insurance company they should repair it or pay out of pocket for the damages done because of their incompetence. Possible exceptions to this would be if the homeowner didn't like the contractors per square price and instead offered them per hour labor only bid. But if the contractor bid the price at per square for their price (say $350/square, labor and materials included) the contractor would absolutely be responsible for any damage for any leaks underneath their installed product.

The tenant has a relationship with the landlord and it is the landlord's responsibility to see that a roof was in proper condition.
