If you put your children at risk, it isn't legal. How responsible is the 10 year old? Where is the closest neighbor if there is a problem, are they responsible? Do either of the children have medical issues? Do you have an ex that will jump at the chance to call you irresponsible if he finds out this is going on? Lots of questions... and there is no black and white legal issue. If you really HAVE to leave these children alone it MIGHT be OK if both are well behaved and there are neighbors they can go to at all times. You are the only one that can answer this question.
