Physically there should not be a problem since he is in puberty and 16yo boys get 16yo girls pregnant. Legally, if he is below the age of consent the sex is illegal and she can go to prison for statutory rape. If he is of legal age to consent to sex and his parents report her, the judge can decide that due to the age difference and the pregnancy the age of consent should be 18 so then she can still go to prison for statutory rape. So legally this is a very bad idea.

It's only legal if the 16yo has reached the age fo consent on her state. Otherwise the father-to-be risk prison time for stautory rape.
