Only if your own comfort is more important than the comfort of your children.
Child support payments usually stop at age 18, unless some payments have been missed along the way ... Providing ALL your payments for child support are fully up to date and paid in full, you can file in court to have these stopped.
No, there is no way to legally "opt out" of child support. If a court order has been established for child support, the obliger is required to continue paying, regardless of whether or not the recipient wants to continue receiving payments.
The custodian of the children is entitled to the child support payments. The only way to keep the mother from getting the child support payments would be to have the grandparents petition the court for custodial rights - which could be extremely difficult, depending on your state.
Child support is based on a percentage of net income. In an official opinion by Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement, child support obligation ceases while incarcerated.
I had my taxes send to the first wife because my ex husband did not send any child support. I can happen that way. I don't think they could attach monthly payments but you can check with a lawyer.
Yes... But usually the courts will use wage garnishment as their first action. Either way, a person would have to be significantly behind on payments and/or not attempting to financially support the child.
Child support pays for the food, clothing, shelter, entertainment, shelter, and health of the child. The parent or caregiver that is authorized to receive these payments has every right and authority to use that money in any way they see fit so long as it is being used to benefit the child.
If you have a garrenishment then your child support is getting paid that way. You should consult an attorney to see if you can they can be stopped, but a garnishment is normally set through the court.
The only way you will have to keep paying child support is if you have back child support that you never payed.. That's the only way they can still get money from you.. I am 15 but the same thing happened with my real dad and me.. If you don't owe child support then you should be free.. The only way to have child support payments stopped is to file a petition with the court asking them to do so. Same is true when a parent dies ... the other spouse must petition the court to have the child support payments stopped.
This would depend on a variety of things. It depends on the laws where you are located as well as the way your child support payments were laid out when given. There are situations where that has happened however, the purpose for child support is to pay to support the child with living (rent, food etc. ). If there is a reason you feel that your money is not going to provide the necessities for your child and being spent else you should go to your lawyer to discuss this situatio further. Also, most child support stops at the time your child turns the age of majority unless stated otherwise in your custody/support payments. I realize this may not directly answer your question but situations such as this vary from situation to situation - it is all individual - the best thing you could do is speak with your lawyer concerning this matter.
Child support payments are not intended to go to the child. They are intended to help maintain the quality of life for the child and custodial parent. That means they go toward rent, utilities such as heat, electricity and hot water, phone expenses, food, clothing, shoes, medical needs, school expenses, transportation, entertainment- if there is anything left, etc. The custodial parent has the right to spend the money in any way money is spent on necessities in an intact family. Once you make your payments you have no control over how the funds are spent.
