Right now it is only your opinion that the child is afraid to return home. The situation needs to be investigated. The non-custodial parent must file a petition in the court that has jurisdiction and then provide compelling evidence that custody should be changed in the best interest of the child. The court may then appoint a guardian ad litem to investigate the situation and report their findings back to the judge.
