It uses checks and balances. The Constitution gives each Branch the ability to override the other, thus making none more powerful than the other.
The 9th Amendment to the Constitution limits the powers of the government to constrict the rights of the people. This means that the people have other rights besides what is written in the wording of the Constitution. The 10th Amendment says that the government has rights that are also not written into the Constitution.

It was the constitution. It was written in 1787,but the authors were inspired by many other documents and ideas that preceded this time period.
That it said they would have equal freedom. In other words they are treated equally and not forced to do anything.

The question answers itself. In the absence of a constitution, NOTHING can be identified as consititutional, because there IS no constitution.
We hold these truths to be self-evident that all men are created equal and endowed by their creator with certain unalienable rights. Contrary to popular belief, the Constitution does not grant rights to the people but expressly prohibits the government from interfering in certain unalienable rights that can only be given (and thus can only be taken) by our Creator. Many of the other papers and communications of the founding fathers also supports these beliefs and the Constitution was actually written to limit the powers of the federal government and not to grant rights to we the people.
