The court does not allow a minor child to arbitrarily change residency from one custodial parent to another unless there is a court order allowing the action. The parent wishing to take custody of the child must file a petition for such in the appropriate state court in the city or county where they or in some cases the child resides.

Father denied paternity during my pregnancy, and filed for divorce 3 weeks into my pregnancy. He only wants custody to avoid paying child support.
He is now expecting another baby with a woman 15 years younger than himself. Oh-we're still married.

∙ 11y agoUsually not until he is 18 but if it goes to court the court will listen to a child from around age 16 but is not obligated to follow the wish.
