Generally, that is a State Jail Felony, depending on the drug (various drugs fall within various penalty groups), meaning that the penalty is 6 months to 2 years in State Jail if the drug is, say, methamphetamine. There is no parole from State Jail, so the sentence is day-for-day.
in the state of washington my first and only meth charge (ten cents worth) I was first sent to drug court, however, I broke my foot and with a doctors order to stay off my foot for 2 weeks, (I had to walk to drug court) I was kicked out of drug court, did 30 days out of 45 ordered and am now a felon at the age of 52. really sucks. not worth it. I think I was unfairly kicked out of drug court which if I had finished the course, I wouldnt be a felon. and remember this, It is still up to the judge. nothing matters except the judge's "final answer". good luck. get clean and you wouldnt have to ask these questions. help is out there. everywhere.

It's a 3rd degree felony under Penal Code § 38.11 and carries a penalty of 2 to 10 years imprisonment and a possible fine up to $10,000.
