Before the 1776 Declaration of Independence and subsequent war with England over independence, there was no national government in the sense that we understand today. Each colony (state) was somewhat independent from the other colonies and each had a governor that was appointed by the British monarch, not elected by the colonists. The duty of the governor was to enforce British law on the colonists and their loyalty was to the Crown before the colony. Each colony had a state legislature which either typically had chosen representatives (usually white male landowners) or direct representation where (again) white male landowners would meet periodically. While these legislative houses would meet and discuss issues, they did not have power to write, enact or enforce any laws in the colony. As "citizens of the British Empire", they were bound to English laws passed by Parliament in England or enacted by the monarch.

The courts of the colonies followed British law and judges were usually assigned by the Monarch.
