The 16th Amendment to the U. S. Constitution cleared the way for Income Taxes.
The 16th Amendment made it legal for the Congress to lay and collect taxes on income. It is the contention of some that because the Congress does NOT do the collecting directly, that is done by the IRS a division of the Executive Branch, every dime of income tax ever collected by the IRS has been collected unconstitutionally. In the US Government, the Executive Branch is responsible for enforcing the laws passed by the Congress.
The 16th Amendment gave Congress the right to collect income taxes. The 17th Amendment established that the Senate would be comprised of two senators from each state. The 18th Amendment established the prohibition of alcohol.
Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;Amendment XVI The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.
