If you credit card has been issued by a bank, it falls under the jurisdiction of the Comptroller of the Currency. It is always a good idea to first contact the credit card company and attempt to resolve the dispute. Do it it writing and do not discuss any of it over the phone. Your written documents are your proof. Regardless, go on line to Comptroller of the Currency and look up how to file a dispute against your card company. They will initially ask you to call a number, describe the nature of your complaint and they will assign you a case number which you will use on all future correspondence with them. They will tell you the next steps including filling out an on line form with more information about the dispute or putting it in writing to them. Once you have done this, give them the time they say it will take to get an answer. If you have not heard back in that time, contact them again referencing your case number. They are very good about getting back to you.
Also- The minute you get this case number, draft a letter to the bank card telling them that you have filed a charge against them with the Comp. Be sure to put on the bottom of that letter a cc:Comp of the Currency. Then send a letter to the Comp. noting the attached (and attach a copy of bank letter) letter to the bank in question. Everything you do and any correspondence with the bank, your answer to that response, etc - note in writing to the Comp. and copy your bank letters to them. Keep very good records of conversations, time, date, person you talked to, and copies of everything you put in writing. Once the Comp. tells you if and what they can do to help you - go from there. The fact that you are getting the Comp involved usually makes bank cards stand up and take notice, which will hopefully work in your favor. Good luck.
