Only if you got it from an illegal pet-tradeing center. I live in Arizona, and I own Emus, Chameleons, Bearded dragons and peasants, none with a licence, and I'm legal. Getting a bearded dragon would be just as safe as getting a hamster.
They are not illegal in the US however it might depend on your state...although i have not heard of a state that doesnt allow them as pets!

Definitely a bearded Dragon, they are much more a tame and active in the day. A beardie will cost you more but i can tell you they are amazing pets. :) P.S I have 2 crested Geckos and 5 Bearded Dragons
