So far as has been reported, there are no new specifically criminal actions created by the Affordable Care Act. The fines (now defined as a tax) that failure to purchase insurance under the individual mandate section are NOT criminal infractions - they are a civil tax consequence, and incur all the normal penalties that failing to pay your taxes would result in.
