Yes. Absent an express agreement in a divorce decree, or if you were stupid enough to obligate yourself to college expenses in an earlier support order, child support terminates at age 21. DO NOT EVER agree to support your children in a court order beyond the legal age, which IS 21! You can always support them further if you feel they deserve it, and YOU decide to. Once you agree to something above and beyond the law, you will lose your ability to be a real parent if you have to be. (e.g. cutting off money to a kid failing her college classes and partying) Leave the decision to send money in your own hands, guys.

There would need to be special circumstances for that to occur. The legal age of majority for New York is 18 at which point the minor child has in legal terms become an adult. Once the age of majority is reached the non custodial parent is no longer obligated to support the 'child' unless the latest support order instructs it to be done.

Generally, orders of support in such cases are only amended if the child has become physically or mentally challenged before he or she reached the age of majority or the age at which the current support order states.

Regardless of the circumstances, any change in an original support order must be done through legal process required by the laws of the state of the child's (person's) residency.

In my opinion, if the child is a full time college student and is will be passing his 21 years of age; he should definitely be covered for child support at least until 23 years of age.
