It is no longer automatic. The non-citizen has to go through the process like everyone else now.

Upon marriage or upon becoming 18 years of age.

If you marry an illegal citizen and you are an American citizen do you have to live together if you have an alternative lifestyle?

First, there's no such thing as an illegal citizen. Second, there's no such thing as an alternative lifestyle. But if you are asking if a marriage between a gay person and an illegal immigrant of the opposite sex would be valid if it is not consummated, that depends upon the laws of the state where the marriage took place. If the marriage was made with the intent for the illegal alien to gain citizenship or permanent resident status, that won't happen. Marrying a U.S. citizen DOES NOT automatically confer citizenship or permanent resident status.

As a British resident but American citizen married to a British man am still an Intl student when applying for further education or considered British?

i do believe Britain requires you to surrender your American passport upon getting a british one, i.e. becoming a citizen of Britain -- no dual citizenship was allowed. at least that was the case a few years ago. so you are still American.

Do you have to take the citizenship test if i marriad to a citizan?

Yes, marriage by a foreign national to a US citizen does not automatically confer US citizenship upon that person.

If a person is married but never took the USA citizenship test do that still make them a US citizen?

No, they were never a citizen; marriage to a US citizen does not automatically make you a citizen. Marriage to a US citizen allows you the a reason to apply citizenship; of which the test is a part of the process. The USA citizenship test is only one of the steps to becoming a citizen; it does not grant you citizenship if you pass it. You still have to apply for citizenship and get through the process. If you want to become a citizen and have been married and never applied for citizenship, then all you have to do now is apply. There is no requirement for you to become a citizen, just because you are married to a citizen. You never have to apply if you don't want to become a citizen. No one will force you to become a citizen just because you are married to a citizen; it is totally a voluntary process. So, if you are concerned that you've been married for 25 years or whatever and you never bothered to apply for citizenship, and now you've decidecd you want to become a citizen, don't worry there is no penalty to wating this long. it has no barring upon your status; its not illegal or anything.

How old does a US citizen have to be to get marry to a Mexican citizen?

The answer depends upon the marriage laws of the jurisdiction in which you will be married. In most U.S. states, two persons can marry at the age of 18, but it is possible to marry at an earlier age with parental consent. The minimum age for marriage is the same whether the parties are both citizens or not. The fact that one is a citizen of Mexico does not change the minimum age. I'm sorry, but I don't pretend to know what the marriage laws of Mexico are, if you are intending to marry in Mexico.

Is there a law that says if a Canadian marries an American then the Canadian becomes American by marriage?

There is no law that states that, however, there is ways for an immigrant and their US citizen spouse to apply for a green card for permanent residency but only upon your petition being approved. The only people that automatically become US citizens are children who are born in the US regardless of parent's nationalities.

Can an illegal alien living in the US legally marry a Canadian citizen in the US?

Is the Canadian citizen also an American citizen or holds citizenship. if so then yes if not then. Technically no. This is because neither party holds a current American citizenship. If the Illegal alien was to marry upon Canadian territory then apply for american citizenship or Visa. But other wise legally no. However they should check.

Can a foreigner obtain EU citizenship by virtue of same-sex marriage to a citizen of Italy celebrated in a country who allows same-sex marriage such as the Netherlands?

It seems like the answer is no. You become an EU citizen when you are a citizen of an EU member. Italian citizens are all EU citizens because Italy is an EU member. You cannot obtain EU citizenship without becoming a citizen of a specific member nation of the EU. Unfortunately, you cannot apply for Italian citizenship based upon same-sex marriage to a citizen of Italy since Italy does not currently recognize same-sex marriages. You can, however, apply for Italian citizenship by naturalization as an individual without relying upon your marriage to an Italian. You must legally reside in Italy for 10 years before applying for naturalization. Another option is for you and your Italian husband to move to another EU country and both apply for citizenship there, but this might be more difficult or take more time. Your family can apply for Belgian citizenship after only 2 years of legal residence, for example. However, it is likely that Italy will recognize same-sex marriage before ten years from now. If Italy does begin to recognize same-sex marriage, then you would need to reside legally in Italy for 2 years after marriage before applying, or be married to an Italian for 3 years if you live abroad. That timeframe is likely to be retroactive, especially is same-sex marriage is legalized by court decision rather than legislatively.

Can an illegal alien become legal by marriage to a US Citizen?

No, but the person you marry can sponsor your citizenship making it easier. It takes about a year, because the us citizen will be investigated and both people have to prove that it is a real marriage and not a ploy just to get citizenship.
