Yes they can if the sex was not consentual but if it was then it is totally legal.
The legal guardian of the under aged (minor) may not "totally" agree with this answer since legal decisions are not usually made by minors as governed by local and state regulations. The 24 year old could be "Contributing to the delinquency of a minor" in any activity engaged by them. Responsibility and consequences for any actions can result in legal charges. Same as violations of curfew, marriage, drinking, etc
