When parents are no longer together, they have no right to decide whether the other parent begins to date, or whom they even date. Hopefully there will have been introduced to the new person in the relationship prior to them spending the night, but unfortunately this is not a requirement regardless of how the other parent feels about it.

The answer to that probably depends a lot on rather or not this parent who consents to the relationship has full custody. If the parent only has partial custody and the other parent disapproves, then you could very well be opening up a big can of worms.
