It usually depends on the power/size of the engine. A small, assist-style engine usually isn't covered by the law at all, but if you try to build something of the power/speed of a moped/scooter it's an entirely different ballgame.
It'd depend on the engine's power/size. Small/weak enough and it's considered and "assist" motor, which are legal. Get the power up, and it will be seen as a scooter, or even a motorbike, and will then have to measure up to all those laws and requirements to be road legal.
