Originally, Captains were granted the power so in case one of the crew members died & were buried at sea they can preside over it. This grant also allows them to marry people.
Now, they can only marry people if they are a registered Justice of the Peace.

∙ 13y ago- Even though it is believed to be a regular event, a ship's captain generally doesn't have the legal right to perform a wedding at sea. In order for a Captain of a ship to perform a marriage at sea, he must be a judge, a justice of the peace, a minister or an officially recognize officiant such as a Notary Public.

∙ 9y agoTechnically, a ship's captain cannot perform a legal wedding ceremony. He may be able to perform a symbolic ceremony, though. Historically, the US has not recognized marriages performed on boats as legally binding.
