If all you have done is give them a deposit then they can do almost whatever they want. If you have a contract you may have additional rights.

Take it to the dealer if mileage is under 20K
In fact I would advise against it on a high mileage transmission.

The mileage is stored in the BCM not the cluster, so you can replace the cluster without changing the odometer reading.
If the financing was being arranged by the dealer he should return your deposit. However, if you were arranging the financing then it is not his fault and depending on the wording of your contract he may be entitled to keep your deposit.
Just asked my dealer the same question for my 2001. He said 100K or 10 Years.

It's possible, though illegal and not likely that a reputable dealer would do it. The later models of vehicles are made to prevent tampering, however older ones can be easily changed. If you are suspicious, look for signs of higher mileage such as excessive wear on the gas pedal and brake, arm rest, and steering wheel.
legally? maybe yes, maybe no...did you sign anything regarding the disposition of the deposit? ...sales agreement? If you used a credit card for the deposit, you could likely contest it if you had a good reason..ie. dealer dishonest, etc. Personally, I think if you just changed your mind you should not get it back..after all that's the reason for a deposit..to hold the car for you..potentially you may have kept the dealer from selling the car to someone else...just my opinion.
That depends on whether you signed anything when you put down the deposit, and whether it was a refundable deposit or a non-refundable one.
