No. Trespass is the crime of going on someone's property without permission. Use of common areas is a property right owned by unit owners. The association cannot charge a unit owner with trespass for using the common areas. The matter must be addressed on another level. The association must rely on the rules and regulations and advice from an attorney who specializes in condominium law.
