No, they have to actually go to the judge and present the evidence showing that the warrant is necessary. If the judge approves, he has to sign the warrant for it to be legal. The officer must then have it with them when they go to wherever the warrant is for. The warrant is also only good for 24 hours, unless otherwise specified.
Added: An officer applying for a warrant does NOT have to produce evidence to the judge of the offense, he only has to swear an oath that Probable Cause exists for the search and/or arrest. Also - although an issuing judge MAY place a service time limit on the warrant, they do not necessarily automatically expire within a 24 hour time limit.
They must provide a judge with probable cause to do a search.
a cop and/or a judge out of his/her files
not if you let him search it
If the cop has a warrant or if he thinks you stole something or if the cop thinks you have a weapon in a place you are not suppose to have the weapon.
Only if they don't have probable cause.
yes, but only after they arrest you
No a representative of the law can not search your house if they do not have permission from the owner of property or a proper search warrant which only a judge can issue. If the officer did so he or she would be breaking amendment number 4 "search and seizers" which is illegal for even them to do.
Absolutely, if the police suspect criminal behaviour, they can get a search warrant and turn the place upside down and inside out!
no it is not, but be aware that if your door is open, even a screen door, it is legal for them to just walk inside warrant or not
no he needs a search warrant
yes it gives him/her probable cause to search the persons outside, but not inside without a warrant. however, he may keep the person's detained until a judge signs a search warrant, which could take 30min. to a few hours. also, pray its not a k-9 unit. if the dog smells drugs, its an automatic ok to search, in most states.
First he will have to show his I.D card, second he must have a proper warrant to search your house, if all this is not there he can stay out.
