If the ex-convict is a convicted felon - yes - they certainly can be charged. Even being in the same house as a firearm is considered being in "constructive possession" of the firearm.

It depends on several things. First, the term "ex-felon" is almost always misused. An ex-felon is someone who is found guilty of a crime, but then at some point later is found to be innocent, as opposed to someone who was in prison for a felony but is now out of prison. That person is STILL a felon, they are just no longer in jail.

Second, a felon cannot have possession of a gun unless they have had their rights restored.
