Sometimes. It depends on your state law. You can sue a 15-year old in some states. In others, you need to sue her parents, who act as the adult represetnatives for her. That said, there's not a lot a 15-year old can do that truly merits a lawsuit. Just be sure that's the highest road to walk.

No. A 13 year old has no legal standing and must be represented by an adult. Which in this case would be the parents. If there is abuse or danger to the child, the state can provide help to protect the child.
