Actually yes they can. If you're living in the home on a month-to-month lease, then the landlord can ask for a security deposit as a condition of your continued tenancy. If you're on a yearly lease, the landlord can ask for a security deposit as a condition of the renewal of your lease, but not while your lease is in effect.
