Apparently so. My landlord just did this to me! 2 months worth of rent taken out my account in one day. Ouch! That's a financial setback for a blue collar girl like myself. It makes you doubt the correctness of your account balancing. "Oh well, it's been a month, surely he deposited it by now....maybe I figured wrong". Don't ever assume that. It's not illegal for landlords to do that, but it is rude and inconsiderate. A landlord should know better than that.....if they expect timely rent payments, tenants should expect timely deposits of the rent payments, no?

Does the landlord have to give back security deposit if tenant refuses to sign lease but moves in?

Normally a security deposit is paid before the lease is signed. Once your lease is mutually signed then you have the right to move in.

Is there a standard pet deposit amount for condo rentals in California?

The deposit that the landlord requires in order for you to live in the home with a pet is up to the landlord to determine. The deposit amount could be based on the value of the home, including the flooring, the size of the animal, the nature of the animal, and so forth. The deposit simply assures the landlord that once your tenancy is over, the property can be made whole again from whatever wear, tear and damage your pet might inflict on the home.In direct answer to your question: no, there is probably no standard or limit.

Can a landlord ask for a second deposit after you've signed a lease?

In many states this is allowable; in many it's not. If your landlord is asking for more deposit then it's up to you whether you want to rent the unit under this new condition. Remember, unless you move out and have caused damage, your landlord has to refund you your deposit-- and all of it. Any damages for which they have provided receipts for repairs must be presented to you, in most states, within 30 days of your departure.

How often can a landlord keep increasing your security deposit for no reason?

Usually once a year, or whenever a lease, or a verbal agreement is renewed. That's for New York State, where I am a landlord. Other states or even counties may differ on the issue.

How long does a landlord have to return a security deposit in the state of Arizona?

In Arizona, a landlord can ask for a security deposit equal to one and a half months rent. Once the tenant vacates the property, the landlord has 14 days to return the deposit. If any part of the deposit is kept, an itemized list must be included.

Can a landlord demand a higher deposit AFTER the lease has been signed and the check for deposit written into lease has been cashed if you have not moved in yet?

Generally speaking, after the release has been mutually signed, it is in effect, and the terms of it cannot be changed. Once the lease has been signed by both parties and the keys have been turned over to you, the tenant, the dwelling then is considered to be in your possession. As such, the landlord cannot turn around and demand a higher deposit. However, in most states, there is a rule of abandonment: if you have not moved into your dwelling in 15 days, and the rent is due, then the landlord can construe this as abandonment and can take possession of the property immediately without judicial proceedings.

Do you have to pay first month rent last month rent and the security deposit the first month on an aparment?

Some landlords require all three, some don't. It's up to the parties to agree on the terms, but the landlord set his terms, and the tenant can take the place or leave it.

What remedies do a lawyer have to collect deposit for tenant?

Please clarify this question. I am assuming you're asking what you can do to get your deposit back once you terminate the lease on your rental unit. Generally you shouldn't need an attorney for this. You need to sue your landlord for the deposit if he refuses to give it back to you, either because he says you damaged the property or because he simply didn't give it back within the time period required (usually about 30 days).

Can a landlord take furnishings from a property once the lease has commenced?

yes

How can a landlord keep my security deposit if don't move in?

It's quite simple: once the lease is mutually signed, something that is normally done after a security deposit has been paid, then the tenant is considered to have legal custody of the property or dwelling. If at that point the tenant does not move in, the security deposit can be kept. This is because the apartment has been rented out and if at the last minute the tenant decides not to move in, then the landlord has to try to rent out the apartment, which may remain vacant until this happens. It should also be noted that the tenant would also be responsible for any rent of the apartment while the apartment is still vacant and up to the remainder of the lease term.

My bank held a deposit for three days during which time checks were returned. Once the deposit wait period is over do they have to return the NSF fees since the money was there?

No, unless it was because of their error. Most likely the money was not really "there". The checks have to be sent to the federal reserve, and then sent to the bank that they were drawn on, and then the money has to be transferred. This takes time. ps - you should change banks, modern software can do this in less than a day, by transmitting the images (pursuant to the check truncation act).

The tenant claims dust allergies and wants the landlord to pay for vent cleaning. tenant has been staying in the townhome for 2 months. Who is responsible for vent cleaning - tenant or landlord?
