No.If he's in "Rehab"he's "trying" to better himself. That is NOT Abandonment.
Exactly what would you want to file? Also, what should be equally filed on mothers denying the father access?
As long as no court actions have been taken against the mother for abandoning the children she can still show up again and demand to see her children. Only court action take take away her parental rights. If the father (or guardian) went to court after the abandonment to get custody he can refuse to allow the mother to see the kids, but the mother can take him to court to gain access to the children. It's very important that fathers file for custody. I've seen cases where the mother came back years later, as to take the kids somewhere, and the where is the court house to file for custody based on possession. By the time there's a full hearing, the judge is unwilling to give the children back to the father. see link
i would say no, only because they could think either ur lying, but also if they still have their mom the child is really not alone.
If the mother is not agreeable, you will need to file a motion in the children's residential jurisdiction. see link
Yes, however the father can file an injunction.
Although the law varies from state to state, a month is not long enough. Most states will require at least a year.
Yes , you see the husband can easily file a case against her , for abandonment.
First, the father must be sure that the mother did not receive permission from the family court to move. If the mother did not get permission from the family court, the father can immediately go to his local family court, and file for full custody of his children. Upon hearing that the mother absconded with the children, a judge will issue an Amber Alert for the children. The children will be retrieved from the state the mother took them to and be returned to the father. Usually this results in the mother receiving supervised visitation for quite a while, since she cannot be trusted to follow a court order.
