You'd be a terrible parent if you did
That depends on the custody orders and the first right of refusal. Why can't they stay with the other parent?
Call the police and report it. * The custodial parent has the legal right to refuse visitation to the non custodial parent if it would place the child or children in jeopardy of harm or neglect. DO Not call the police. Contact the attorney who handled the custody case or if that is not possible contact the state's department of family and children's services for assistance.
They can but their children may be taken away by the state. Some people whose religious beliefs force them to endanger their children's lives are actually relieved that the responsibility is taken from them....
The parent would get support from the children's father--only while the children are in her custody as minors.
if you have not taken care of what you need to in court then you cant you can get chaged with kidnapping!by the why if the kids are in no danger then its not good to take them away a child needs there dad as much as there mom!so if theres any way you can fix what ever happend between you and your hosben and still be friends for kids or kid that would be the best way to do it!!!! * If no court order of custody has been granted the law presumes both parents share equal custody rights. The mother can take the children to live at another residence that is not out of state but she cannot refuse the father the right for equal time with the children. If the father were to take the children to his in state residence with the knowledge of the mother then parental kidnapping or abduction is not applicable.
Yes, but the children goes to the other parent to live while you're gone.
In the state of Louisiana, it is possible for a parent, withut a lawyer, to file a motion for temporary custody while the other parent is in possession of the child and refusing visitation.
Not unless there has been previous documented concern about the safety of the children while in her care. Once people are no longer together, the other parent has no right to decide how the other lives their life, who they date, whether they even date at all etc. As long as the children are properly cared for with food, clothes, a roof over their head, love etc, then the other parent needs to step out of their ex's personal life.
The most likely scenario is that the children will live with the other parent as long as that parent was not deemed unfit while the custodial parent was alive. If that parent was denied custody for cause the courts may consider another gaurdian should the non custodial parent still be considered unsuitable.
Your kids and your lawyer need to have a little chat about that. NOW. The kids can feel guilty for being snitches.... better that than dead.
Yes, a parent CONVICTED of sexual offenses can still keep their children although it would probably be under the close supervision of the Department of Children and Family Services (or equivelant agency).
Paternal is related to the father while maternal is related to the mother. Example: Your maternal parent is your mother and your paternal parent is your father.
