Yes they can. Some people will die without food in that time period, but many can live to that extent and longer. The average person will live 4-6 weeks, the eqvuivalent of 28-42 days without food, so it is definetly entirely possible.
Most people will die in this time frame, but it is not absuredly rare for someone to survive on total starvation for forty days. Part of the dependance is on whether you are used to being starved, and how much the body has to eat.
