The police officer used discretion when deciding whether to issue a warning or a ticket for the minor traffic violation.
It depends on the policies of the local police department. It isn't illegal to do so, and most police departments will hire officers if they have a ticket, as long as the ticket is for something minor, such as speeding.
It means the police officer has a choice. example: a police officer pulls you over for a minor traffic violation (not stopping at a stop sign) he has a choice of whether to give you a ticket or a warning (written or verbal). This is called discretion. Another example would be urinating in public, the officer uses his/her discretion on whether or not to make an arrest or just issue a ticket violation. Police don't have discretion in all circumstances. Law and departmental policy can limit or eliminate discretion. For example, if an officer witnesses a felony, law requires the officer arrest the suspect. And, departmental policy might require an officer issue citations for all seat belt violations.
If the officer took your name or ID or if you were responsible for those minors then you should just assume so. You can check though, especially if an MIP (minor in possession) ticket was issue, just ask for a copy of the police report and reference the ticket number.
Yes. If you are a minor, you do not have to be drunk to be ticketed. All they have to do is find open containers of alchohol in your possession.
No
I don't know what or if there is a term regarding this but I do know that the minor doesn't have to answer any of the questions the police officer asks. You have the right to remain silent even if the police officer has authority. It's not a law that you must answer all questions the police officer asks you.
Yes.
Yes. As long as they are within their jurisdictional boundaries they may personally issue you a citation. Officers/Deputies/Troopers are on duty 24/7 and there certifications are maintained by the Florida Dept. of Law Enforcement. This said they must also stop to render aid or deter criminal offenses that occur in their presence. In Florida there is no such thing as "off duty."
No. The issue is a minor one and if all the other information is correct, the name of the driver, plate number etc. the ticket is valid.
