yeah,obviously its against our civil rights because every citizen has his own opinion about everything ,if he is not willing to give a blood sample then there is no governing body or individual to draw a sample without his consent.its against the international law,

∙ 14y agoNo, they are not allowed to take your blood without your consent. Unless they are getting a DNA sample for murder and the judge oks the blood test. But even at that it is really rare for a judge to let it go through.

∙ 12y agono you have the right to refuse, but you can still get charged for whatever reason they want it, and they can take your leicends and suspend it
Another View: Check the wording of your state license laws. It is quite likely that when you signed to receive your license you gave the state the implicit authority, should the occasion ever arise, to test you for blood-alcohol levels, even against your objection.

∙ 12y agoYes, if he has probable cause to take the blood and the evidence that will be obtained is dissipating. A common example is when someone is arrested for driving under the influence. Some circumstances do not permit the accused to refuse to provide a sample for blood alcohol testing, and the officer can use force to obtain a blood sample, if necessary.

You should clarify your answer. I assume you meant to ask "Does a drunk driver have to submit a blood sample?" To my knowledge, all states have implied consent. That means that by driving you automatically give consent to submit to blood alcohol testing. The police will not hold a gun to your head until you submit, but if you refuse, your penalties are much higher. Also, you can submit a breath sample too. It doesn't have to be blood. In the 50 or so DUI's I've written, I don't think I've ever had to use blood. They either sumit a breath sample or refuse altogether.
