It depends. A school person can use "reasonable force" in getting students under control. The key is what a reasonable and prudent person would do under the circumstances that are present when the incident occurs.

Only if it is truly necessary, in a situation where the student is in a dangerous situation, perhaps attacking another student, or attempting to jump out of the window. If the student has done nothing worse than making a disrespectful remark, the teacher would not be justified in laying hands on the student.

=not really maybe by the arm if its truly nessecery but not when not and never the neck

AnswerAny person is allowed to intervene in a violent or potentially violent confrontation.

Any person may restrain another person if that person is committing a crime or it can be proven that a reasonable person would think a crime was about to be committed.

That means:A teacher may pull back on a students arm but only hard enough to accomplish the goal of preventing or stopping the crime

The problem comes in when the person being restrained is injured or claims that the intervention was not necessary or proper.

By the way if a teacher thinks you are disruptive in class and decides two things

  1. You are to be expelled from the class
  2. And he reasonably thinks you are going to resist he may eject you by force.

And he does not have to tell you why until it is accomplished.
