Not enough information. What kind of "agreement" is being referred to? If it is a legally enforceable contract, yes. If it is anything less than a formal contract for access, it becomes much more unclear. ALSO: If by cutting off the well rights, you leave a family residence without a source of potable water you could be in violation of Health Department regulations. Check carefully before taking any action.

Sample Loan Agreement?

Any time a loan is paid, the borrower and lender should sign a loan agreement. The loan agreement, which is also commonly referred to as a promissory note, makes the agreement between the parties and the exchange of funds official. By having a loan agreement, there may be legal recourse in the event the borrower does not repay the loan as agreed in the contract. Even when money is being loan to a family member or longtime friend, the loan agreement is important to validate the exchange of monies. Having a sample loan agreement will serve to protect the borrower as well as outline the terms of the contract. The agreement should also include the amount borrowed as well as the interest rate that is being charged on the loan. Having the contract written and signed by all parties prevents the borrower or the lender from changing the terms of the original agreement. To be included in the sample loan agreement is a simple statement that a loan is being made. Although this seems elementary it is important this is included so there is a distinction made between money being borrowed and monies being given with no repayment obligation. The understanding with the agreement is that under the terms of the agreement the funds are to be lent for specific period of time. Included in the sample loan agreement should be the date the monies are being exchanged. Although less important, but still to be included in a loan agreement is the city and state where the loan is being made and disbursed. Whether a loan is being made for business or personal financing, all parties should be named in the agreement. In the case of an individual, the individual's full name should be included in the agreement. If there is a co-borrower on the loan, his or her name should be included as well. In the case of a business, either the guarantor or corporation name should be listed on the contract. It is key to understand the business designation and structure of the business; a sole proprietor will need to be named while the owners of a corporation may not be named because of certain limited liability provisions. Within the loan agreement there should be language to include how and when the funds borrowed will be repaid. If there is any distinction that needs to be made about how the loan should be repaid, such as by check, credit or money order this should be outlined. The date the funds will be repaid should also be clearly stated and agreed to by all parties involved. The key to the loan agreement is to protect the interests of all parties involved and by clearly stating the terms of the loan and obtaining signatures, the chances of default and misunderstanding will be minimized.

What to Include in a Lease Agreement?

If you're leasing a piece of property to an individual or a business, it's more important than ever to protect your legal interests. From damage to your property to missed payments, leasing property can easily become a legal minefield, so it pays to have every protection you can set in place before the lease even begins. To do this, you need to have a legally sound agreement drafted, and you need to be assured that all parties involved have a clear understanding of the terms and conditions of the agreement.Key Elements to Include in Any Lease AgreementEssentially, a lease agreement needs to contain a few key elements: what property is being leased, the identity of the parties involved in the agreement, the length of the lease, as well as information on payments. These elements are important in order to establish exactly what property is being leased in the agreement, who will have possession of the property and who retains actual ownership, how long the lease will be for and how any payments will be handled. Having these elements allows all parties in a lease agreement to have a clear understanding of the agreement as a whole, and they also offer protection for both parties if the agreement is used in court. What Happens if the Lease Agreement is Broken? You will also want to include terms and conditions within your lease agreement that address penalties if payments are missed, if the leased property is damaged, as well as what legal recourse all agreeing parties have if the lease is broken. This may mean defining an actual monetary value for specific damages, or it may discuss a security deposit requirement that will be used specifically for damage to the leased property. Once again, this information can be crucial if the lease agreement is used as evidence in court.Miscellaneous Information to IncludeMany lease agreements may include miscellaneous information, such as stipulations of use on the leased property. These guidelines ensure that the leased property will be used for its intended purpose, and are often put in place for the property owner's protection. An example of this would be where someone is leasing a home to another individual. The lease agreement may stipulate that the home being leased can not be used as a commercial business, as this may cause the property owner to incur fees from the city or county where the property is registered.

What is a nondisclosure agreement?

The non-disclosure agreement (NDA), sometimes also referred to as a confidentiality agreement or a propriety information agreement, is a contract that contains either personal or company related confidential information. The signed parties, typically consisting of two or more individuals or businesses, use the non-disclosure agreement to convey secret information or knowledge either from one party to another or between both parties. The agreement is to ensure that, while they are sharing information with one another, the knowledge will remain secret from all other parties. The typical non-disclosure agreement is formed between two companies which have reached a business agreement. In order to work together in the future, it becomes necessary for these companies to share certain trade secrets and other information. In other scenarios, an employee and an employer may sign a NDA which may contain confidential company knowledge which would prevent the employee from releasing the enclosed information to third parties. The majority of non-disclosure agreements are termed “unilateral” in that they consist of one party releasing information to another. The NDA is to ensure that while releasing the knowledge to the necessary party, the information will not be shared with any other individual or group. Another form of non-disclosure agreement, the mutual agreement, consists of two parties sharing information with one another. There are several clauses that are typically contained within an NDA. The agreement first lists the individuals or companies which are parties to the contract. The document would then list the confidential information that is subject to party secrecy. This knowledge ranges from unpublished patents, financial data, as well as lists of all customers and vendors. The agreement also usually contains a clause stating that any information that was previously known by the signer(s) is not subject to confidentiality. The contract will then usually state the length of the agreement followed by the actual terms of the agreement. This includes all of the obligations that either one or both the parties have in regards to the disclosed information. Finally, the non-disclosure agreement will state the situations in which the information is allowed to be disclosed. This may be the case during court cases and other legal proceedings.

Premarital Agreement?

Get StartedA Premarital Agreement is an agreement between prospective spouses, made in contemplation of marriage. The Agreement becomes effective upon marriage. The Premarital Agreement should be discussed by the parties well in advance of the marriage. Sufficient time should be permitted to allow both parties to consult their separate legal counsel and to sufficiently consider the Agreement. Otherwise, one party may later claim that the Agreement is unenforceable because it was misleading or signed under pressure. The Agreement is generally unenforceable if it was signed after the marriage ceremony. From a legal perspective, marriage can be viewed similar to a business arrangement. Business transactions should not be entered into without documenting the terms of the arrangement in writing. Likewise, the parties in a marriage should carefully consider how issues will be handled during and/or after a marriage. Without an agreement, the probate court (upon death) or the divorce court will impose an agreement on the parties in those circumstances.Property RightsA number of issues can be clarified in a Premarital Agreement pertaining to property rights. For example, the agreement can specify how property -- previously owned or acquired during the marriage -- will be distributed upon divorce or death. Other items which may be addressed include:The handling of debts and expenses;Rights to inherit from each other;Rights to be named as the beneficiary of life insurance or retirement plans; andAny other matter regarding the parties' rights and obligations, as long as the agreement does not violate public policy concepts or criminal laws.Certain Provisions Not EnforceableCertain Agreement provisions may not be enforceable, such as provisions relieving one party from paying child support or alimony. State law or public policy may prevent a court from enforcing such provisions. Because of differences between the states, the drafting of such provisions should be done in consultation with a lawyer.

What does an average rental agreement cover?

A rental agreement for a car or appliance will have very different terms than a lease for an apartment, but all rental agreements must have a few material terms included.
