That would probably depend on your employer. It should not however, reduce your WCI, benefit.

AnswerI'm not really sure why you would want to use your available vacation pay hours, if the carrier/adjuster is indeed paying you TTD (Temporary Total Disability) or PPD (Permanent Partial Disability)????

It's usually the other way around; people are fighting to NOT HAVE to use vacation pay or sick pay or some benefit other than temporary total disability, which is available under Workers' Compensation provisions.

In California, No, an employer cannot make an injured employee use his/her vacation pay for workman's compensation Unless the employee is using sick days/ or vacation time to heal an injury.

However, if an employee was injured while on the job, he/she should report it to the HR office go get medical treatment preferably from his/her doctor and then if necessary file a workman's comp claim and collect workmen comp benefits.

I'd suggest considering how injured one is, how much time is required to heal, and whether or not the injury was 100% from an unsafe working environment. If the time off from work is an extensive period of time, it is better to file a workers comp claim.

If one would only be off of work for a few days, to one week it might be better to discuss / negotiate with the HR about time off and vacation pay. Depending on the whether it was unsafe working environment or just an accident ..(only my opinion

I WORK AT subway restaurants for over 4 year. I WAS GETTING 40 HOUR A week and then my hour got cut down. I now get 35 hours a week and I work about 5 to 6 days a week. So I want to known if I can get vacation with pay? I would appreciate if you can email me back....

Whether or not a company will let an employee earn vacation time while on Workman's Comp. is up to the company. Most companies will make a person on Workman's Comp. use all vacation time they have coming and not let them accrue more until they return to work.

Hi,

In general, no. However, that answer is not without some caveats. I live and work in WA state and am unfamiliar with laws elsewhere. Also, if you are working with a vocational counselor because you are unable to return to your previous job duties, you can receive benefits while training and or going to school.
