Can an employer in a California office or plant search an employee's desk or locker or purse without the employee's permission?

It would depend on where you work. An employer should have a form of an 'employees handbook' which outlines the rules. In most jobs, an employer can search an employee's work area because that belongs to the employer, but a locker is usually a designated space of the employee and a purse is the private property of the employee. However, there are exceptions based on the security and safety requirements of the employer, that is why it would make a difference where you work and what the rules for employees are. It would make a big difference if you worked in a secure facility, or a place with hazards for the employee or the public. When you go to work for someone, you should be provided the rules that apply to your employment; if you've never received that, get it now. Remaining ignorant of the facts leaves you vulnerable to victimization. If you have the rules and know the rules and follow the rules, you will always know where you stand.

Are employers required to provide a place for personal belongings?

OSHA does not require employers to provide a place for personal belongings. Most employers would suggest to you not to bring any valuables to the workplace, however, I good employer who cares for their employees will provide lockers for their employee's. The downside to having a personal storage space provided by the employer is that they have a right to search the locker IF circumstances require it.

Does a home based business have to pay payroll taxes for an employee?

It depends on if the employee is considered a contractor meaning does the employer have any say in how results are produced and if the employee makes over $500.00 If the employee is not a contractor, then taxes need to be paid by the employer and the employee. A good place to get more information on this is a local small business association.

Does an employee have the right to refuse to sign a write-up from the employer?

Probably, but you should check with the policies and procedures that are in place. One problem is that the employer will place the write-up in your file with an indication that you refused to sign. Another option will be to write a response to the employer, and ask to have your response placed in your file as well. Your employer will probably be ok honoring your request.

What is Minnesotas law on supervisors and managers sharing the tips of employees.?

From Minn. Stat. s. 177.24: "Any gratuity received by an employee or deposited in or about a place of business for personal services rendered by an employee is the sole property of the employee. No employer may require an employee to contribute or share a gratuity received by the employee with the employer or other employees or to contribute any or all of the gratuity to a fund or pool operated for the benefit of the employer or employees.
