No. The will must be submitted to the probate court where it must be proved and allowed. The executor must be appointed by the court in order to have any authority over the estate. Then, the debts of the decedent must be paid before any assets are distributed.

How do you change the executor of a will?

The individual has his or her will amended to show the new named executor or executrix. The amending will need to be witnessed and notarized (preferably) in the same manner as the original document, but not neccessarily by the original witnesses. An executor or executrix who has been appointed by the probate court or was named by the testator (testrix) must be relieved of the responsibility through the court.

A credit card is when you are loaned money by the card company and are able to use it before hand; after which you have to pay them back. A debit card on the other hand is a card with your money on it and you use it as you wish but once the card has no money left, you have to put more money on it before you can use it again.

Are executive different from producers?

Yes the executive producer is completely different towards a film producer. Executive Producer=Executor, Manager, Producer Executor=paying the tax and insurance and filling paper and forms and collecting money from the insurance and the income. Manager= controlling and supervising the matters creative production Producer=Paying the money to make the film. Film producer on other hand is just a producer someone who collects money from the executive and pay for the production. The executive still pays for the production.

Can an executor petition the court for a co-executor to assist them?

You can petition the court for appointment of a co-executor. It depends on the practice in your particular court. The court may question why you accepted the appointment if you can't perform your duties and may want to appoint a replacement. On the other hand, it may allow your petition. You should consult with the attorney who is handling the estate.

Can an executor place a house for rent that is still in probate?

This question has two potential answers depending upon whether the executor is the one renting the property or the beneficiary designated to receive it under the will is renting the property. If you mean rented by the executor, it may be at any time as soon as the will is probated and an executor is appointed to act. (Or an administrator if there is no will.) Most states have a statute taken from the Uniform Probate Code that gives the executor possession and control over every asset of the estate during administration of the estate even to the exclusion of beneficiarires who are designated to receive the property. During administration only the executor may rent it out, but the executor retains the discretion to decide if renting it is beneficial to the estate. Thus, even though an executor has the power to rent it out, he or she does not have to do so and cannot be forced to do do by a beneficiary unless a court orders it. If you mean rented by the ultimate beneficiary, the beneficiary cannot rent it out until the executor formally transfers the property from the estate to the beneficiary even if the will explicitly gives the house to that beneficiary. Once it is transferred, it is no longer part of the estate and the executor has no legal right to possession or control, therefore no right to rent it out or refuse to rent it out. The transfer to the beneficiary might have to wait until final settlement of the estate just to make sure that it does not have to be sold to pay for debts or expenses. On the other hand, if an executor is reasonably certain that it is not needed for that, the executor may in his discretion transfer the property before finalizing the estate. I believe it is best to transfer the house as quickly as possible during administration as long as it is clear that there are sufficient liquid assets to pay for everything. That way the executor is no longer responsible for the safety of the asset and he or she has a happy beneficiary.

Can appointed executor apoint a co such as a spouce?

No. Only the court can appoint a co-executor. Appointment of co-executors is routine if co-executors are named in the Will. The court generally appoints those who are named unless objections to the appointments are filed. If the executor finds they need help they could petition the court to appoint a co-executor or an agent, depending on the jurisdiction. The court would review the petition and render a decision. On the other hand, if the appointed executor cannot handle the task the court may appoint a successor.
