Serious : According to the terms and conditions of the program, they cannot be. However, there is no law against it, so the penalties are limited to things the airline can do on its own. You can't actually sell the miles, but you can sell the use of the miles by using them to get an award ticket in the buyer's name.
If the airline (Delta or any other) catches you they're likely to close your account, confiscate all your remaining miles, and refuse to honor the award ticket when the buyer shows up at the airport expecting to fly. Most airlines employ a staff of people who monitor eBay and other likely sites looking for people trying to buy, or sell, frequent flyer miles. They're quite good at what they do. Buying or selling miles is a gamble on both sides.
