No. I assume you are referring to the Wendy's fast food "frosty." The frosty is marketed as a "frozen dessert." In order to legally be called ice cream, it would have to have a higher percentage of milk fat. The frosty is more likely to be legally classified as "ice milk", as is the McDonald's sundae. Ice milk is cheaper to make than ice cream. The name "ice milk" is unappealing and that is why companies find a way to create the appearance of ice cream, but use vague descriptions to hide that the product is actually ice milk.
