Actually, some cemeteries allow this. The plots are usually "double-decker" style, where the first decedent is buried deeper, creating the remaining space for the second decedent. This is more common in spousal plots.

It probably would be since may (most?) allow more than one burial in the same plot (one casket layered atop the other). It would have more to do with the regulations that govern the cemetery (which is after all) private property.
