I'm not sure about the legality of it, but a person I know was fired for insubordination. I'm not sure how the incident occurred but from what I know the person asked the owner of the Co. if they could help with the issue at hand and he stated that's what they were hired for so he wouldn't have to deal with those issues. So I think that was unjust and that the person should fight it, but then again I just heard one side of the story. So with that being said, I'm not sure if this person mouthed off or had an attitude or if this was ongoing thing with the person I know. I know we tend to give attitude as a way to put up our guard when we feel we are being attacked, but I've done some research and it says that some places do fire for not following orders or for giving attitude and/or following orders but having a fit about it. I would take legal action if I absolutely knew that I was fired unjustly Hope this helps.

Yes, one can be fired for gross insubordination. Bear in mind that this is a refusal to do one's job. One can refuse to do other things that are not part of one's job.
