Yes, if it is fake it is fraud to sell it as something that it isn't is illegal. The very least that could happen to you is that you could be sued by the person you sold it to for the price of the item plus other fees. Depending on the price you could be arrested for the fraud.

I assume you are stating "selling" you fake insurance. If so, the answer is yes you can and should sue them for selling you fake insurance. The State Department of Insurance will also probably pursue criminal charges against them as well.

If the badge is clearly plastic, fake, and from a pack of toys; then no. But if it's made out of metal and looks similar to your state badge, then maybe not arrested, but fined. Or warned.

Making a fake ID is illegal. If anyone tries to use a fake ID in a place that serves alcohol, they risk getting arrested.
