Any driving activity, regardless of it being a moving violation or not, without a valid drivers license is against the law. Even if you drive perfectly without a license, it is still illegal. Driving is a privilege, not a right.
Whether or not one goes to jail is up to the local laws where the arrest is made. Quite certain one would be "booked" at the local police station and may have to make bail in order to be released.
