A Mechanic's lien can be placed on a jointly owned home without the necessity of a lawsuit. All other liens against real property even that which is jointly owned must be obtained through the prescribed legal procedure (lawsuit) of the state in which the property is located.

Yes. It depends on the type of tenancy as to how effective the lien will be. A lien against one spouse for their own debt is not effective if the property is held by survivorship. Property owned by multiple tenants in common or in a joint tenancy is subject to the liens of one co-owner but only as to that co-owner's interest.
