Can a landlord file a claim if the tenant dies owing rent?

Can a tenant demand security deposit when moved out owing rent and gave no notice?

If no notice is given, then the tenant owes for the next month, if the landlord tries to rent the unit and cannot. The security deposit can be applied to the arrearage - the landlord needs to write the tenant a letter so stating.

Tenant files for chapter7 bankruptcy?

When a tenant files for bankruptcy, this will apply to any money tenant owes. In the case of rents, which is not a form of credit, you still must pay to landlord your rent or face the probability of eviction. If you owe your landlord back rent and declare bankruptcy, then you can include this back rent as part of your debt. Back rent is considered a form of credit, because you owe this money to your landlord and he has continued to grant you the right to stay there. It should be noted that whenever a landlord commences eviction proceedings against a tenant, it is never on the grounds of owing back rent. Your landlord's claims against you in small claims court covers that issue.

What is Tennessee law regarding landlord withholding deposit upon end of lease?

In Tennessee, landlords must return a tenant's security deposit within 30 days of the lease ending. If the landlord wishes to withhold a portion of the deposit, they must provide an itemized list of deductions along with any remaining funds owed to the tenant. Failure to do so may result in the landlord owing the tenant double the amount wrongfully withheld.

Does a landlord need your social insurance number to do a credit check?

DEFINITELY!!!! If you are a landlord you must have the tenant's social security number in order to properly screen the tenant (i.e. run a credit check, use online reference databases such as www.AboutTenants.com). If you end up renting to that person and they move out owing you money then you will need the SSN in order to obtain a judgment in small claims court and garnish wages.

What questions do you as the landlord ask when calling personal references?

Keep in mind that the main reason that you want personal references is to help track down the person in case they run out on any money they may wind up owing you. Secondly you can learn much about a person's character from the people that they are listing as references. Ask the person: How long have you known the prospective tenant? Are you related to the tenant? If not related; How doyou know the tenant? (for instance - from a job or church?) How would you describe the prospective tenant's good qualities?

Can a landlord give out personal information to your references?

Can a landlord give out your personal information about me owing her money to my coworkers and all my business and telling me i need to give her a 30 day notice when she told me to move out in 3 days

How the Eviction Process Works?

Eviction is an ugly and scary process. People who are facing eviction have rights that are often overlooked because fear has gripped them. Each state has different eviction laws and some towns/cities have local laws that can help a person in danger of eviction. Eviction is the act of a landlord forcing a person to leave a home or business for of lack of payment for past due rent. The process is a long and arduous one for people who are going through it. The first thing that has to occur in most states is the tenant's failure to pay rent. There are several other reasons that someone might be evicted from the home as well. Other than owing rent, the tenant must follow the lease to the letter to avoid eviction. If the lease allows only one person to live in the dwelling (home) and there is more than one person living there, the landlord can evict the tenant. If the lease says "no pets" and a pet is living in the home, the landlord can evict the tenant. The landlord has to take the case to court in order to obtain an eviction. The most common type of eviction is for non-payment of rent. The landlord cannot file for an eviction until the day after the rent is due. As soon as the rent is past due, even by one day, the landlord has the right to file in court. After the landlord files the paperwork, a court date will be assigned. The court date is generally about two weeks from the date the landlord filed. If the rent is paid prior to the court date, the tenant does not have to appear in court. If the tenant does not pay, he or she can show up in court to state why he or she did not pay rent. The eviction process will likely go in favor of the landlord. The tenant will be sent a notice, in most cases, after the police are contacted and an eviction day is set. The police will escort the landlord to the home and the eviction process will take place. The only way to stop eviction in this case is to pay the rent prior to the eviction date. In that case, the tenant will be able to remain in the dwelling. If the three orders of eviction are given by a judge in a one year period, it results in an automatic eviction in most states.

Can co-signing for your sons rental apartment hurt your credit?

If your son moves out owing money beyond the amount of his deposit, you will be in the hook for that full amount; if you don't pay that balance, then it can negatively affect your credit in as much as you have an unpaid debt that is in default. You are on the hook for the duration of the tenancy, or until the lease is renegotiated to exclude you as a cosignor. You will be responsible for all charges, including rent, late fees, cleaning, damages, etc.; if he is evicted you will also be responsible for the costs of the eviction; oftentimes the landlord is responsible for the tenant's final utility bill as well, which will in turn be passed onto you. Don't cosign unless you have the willingness and the money to pay in full when he leaves owing a balance. IF you do cosign, it would behoove you to follow up with the landlord each and every month to verify that the rent is being paid, and utilities, and find out about his mode of living, i.e., if he is running a 'party house' so you can have an idea about how much cleaning and damages you can expect to pay for when he moves out. Remember that there will be nothing you can do to force the matter, you will just have to buckle down and pay is rent, etc. or our credit will suffer with his. If it were me, rather than cosigning I would help him find ways to do it on his own.

Do you still owe rent after being evicted if their was no lease involed?

This is somewhat you mean by owing rent. If you were evicted for nonpayment of rent than the landlord could sue you for the money you owe in back rent. Since there was no lease involved, your landlord cannot sue for future rent.
